ClawSwap — Terms of Service

Effective Date: February 16, 2026

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the ClawSwap protocol, application programming interface ("API"), software development kit ("SDK"), Model Context Protocol ("MCP") server, and related services (collectively, the "Service") made available by the ClawSwap decentralized autonomous organization and its contributors ("ClawSwap," "we," "us," or "our").

By accessing or using the Service, you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service. "User" includes both human operators and autonomous software agents ("Agents") acting on behalf of a human principal.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be communicated through our documentation, website, or API response headers.

2. Description of Service

ClawSwap provides cross-chain token swap infrastructure enabling gasless, x402-paywalled transfers between the Solana and Base blockchains. The Service includes:

  • REST API: Programmatic endpoints for obtaining quotes, executing swaps, and checking transaction status, accessible at api.clawswap.xyz.
  • SDK: TypeScript client libraries (@clawswap/sdk and related packages) published on npm for integration into Agent frameworks.
  • MCP Server: A Model Context Protocol endpoint enabling AI agents to discover and invoke swap functionality.
  • OpenClaw Skill: An integration module for the OpenClaw/Moltbook agent ecosystem.
  • Frontend Application: A web-based interface at clawswap.xyz for demonstration and direct use.

ClawSwap is infrastructure software. It does not custody user funds, operate as a financial intermediary, or provide financial advice.

3. Eligibility and Restricted Jurisdictions

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement.

The Service is not available to persons or entities located in, incorporated in, or otherwise subject to the jurisdiction of any country, territory, or region subject to comprehensive sanctions imposed by the United States Office of Foreign Assets Control ("OFAC"). These currently include, but are not limited to: Cuba, Iran, North Korea, Syria, the Crimea, Donetsk, and Luhansk regions of Ukraine, and any other jurisdiction designated under OFAC sanctions programs.

You represent and warrant that you are not: (a) located in, ordinarily resident in, or organized under the laws of any OFAC-sanctioned jurisdiction; (b) identified on the Specially Designated Nationals and Blocked Persons List ("SDN List") or any other sanctions list maintained by OFAC; or (c) acting on behalf of any person or entity described in (a) or (b). We reserve the right to restrict access from any jurisdiction at our discretion.

4. x402 Payment Terms

4.1 Payment Model

The Service uses the x402 (HTTP 402) payment protocol to gate access to paid endpoints. When you call a paid endpoint (e.g., /api/swap/execute), the Service returns an HTTP 402 response containing payment requirements. Your x402-compatible client must complete the specified USDC payment before the request is processed.

4.2 Pricing

Swap execution is priced at a flat fee of $0.50 USD equivalent in USDC per swap, payable on the Solana blockchain (Phase 1) or Base blockchain (Phase 2). Quote retrieval, status checks, and informational endpoints are free. We reserve the right to modify pricing with reasonable notice communicated through API response headers and documentation updates.

4.3 Payment Finality

All x402 payments are settled on-chain and are final and non-refundable once confirmed by the respective blockchain network. Payment verification is performed by a third-party facilitator (currently Dexter at x402.dexter.cash). ClawSwap does not control and is not responsible for the facilitator's availability or performance.

4.4 Failed Transactions

If a swap fails after x402 payment has been verified and settled, ClawSwap will make commercially reasonable efforts to diagnose the failure. However, x402 payments are for API access, not guaranteed swap outcomes. Bridge failures, slippage beyond tolerance, or blockchain congestion may result in failed swaps for which the x402 fee is not refunded. In cases where the failure is attributable to a ClawSwap system error, we may, at our sole discretion, issue credits or process refunds.

5. API and SDK Usage Terms

5.1 Permitted Use

You may use the API, SDK, MCP server, and OpenClaw Skill to integrate cross-chain swap functionality into your applications, agents, or services. You agree to use the Service only for lawful purposes and in accordance with these Terms.

5.2 Prohibited Conduct

You shall not:

  • Use the Service to facilitate money laundering, terrorist financing, sanctions evasion, or any illegal activity.
  • Attempt to circumvent, disable, or interfere with the x402 payment mechanism or any security features of the Service.
  • Submit fraudulent, manipulated, or malicious transaction data to the API.
  • Conduct automated testing, stress testing, or denial-of-service activities against the Service without prior written approval.
  • Reverse engineer, decompile, or disassemble the Service except as expressly permitted by applicable law.
  • Misrepresent your identity, jurisdiction, or the nature of your transactions.
  • Use the Service to manipulate token markets, conduct wash trading, or engage in any form of market abuse.

5.3 Rate Limits and Fair Use

The Service may impose rate limits on API calls. Exceeding rate limits may result in temporary or permanent suspension of access. Current rate limits are published in the API documentation and may be adjusted without prior notice.

5.4 Agent-Specific Terms

If you deploy an autonomous Agent that interacts with the Service, you (as the Agent's principal/operator) are responsible for all actions taken by your Agent through the Service, including all x402 payments initiated and all swap transactions executed. Agents must comply with all terms applicable to human users.

6. Gas Sponsorship

ClawSwap may sponsor blockchain transaction fees ("gas") for swap execution on behalf of Users. Gas sponsorship is provided as a convenience and is not guaranteed. We reserve the right to discontinue, modify, or limit gas sponsorship at any time, including imposing per-user or per-transaction caps. Abuse of gas sponsorship (including but not limited to Sybil attacks, wash transactions, or excessive volume) may result in suspension of sponsorship privileges or termination of access to the Service.

7. CLAWS Token Disclaimer

The CLAWS token is a community token issued on the Solana blockchain. The following disclaimers apply:

  • Not a Security: CLAWS is not a security, investment contract, equity, debt instrument, or any other form of regulated financial instrument. Purchasing, holding, or using CLAWS does not entitle you to any ownership, dividends, profit-sharing, or governance rights in ClawSwap or any associated entity.
  • No Investment Advice: Nothing in these Terms, on the ClawSwap website, or communicated by ClawSwap contributors constitutes investment, financial, tax, or legal advice. You should consult your own professional advisors before purchasing CLAWS or using the Service.
  • Extreme Volatility: The value of CLAWS may fluctuate significantly, including to zero. You may lose your entire investment. Past performance is not indicative of future results.
  • No Guarantees: ClawSwap makes no representations or warranties regarding the value, utility, liquidity, or future availability of the CLAWS token. The token's utility within the ClawSwap ecosystem may change or be discontinued.
  • Regulatory Risk: The regulatory status of tokens like CLAWS is uncertain and evolving. Future laws, regulations, or enforcement actions may adversely affect the token's legality, value, or transferability in your jurisdiction.
  • Launch Platform Risk: CLAWS may be launched on third-party platforms (e.g., pump.fun). ClawSwap is not responsible for the performance, security, or policies of such platforms.

You acknowledge that you acquire CLAWS entirely at your own risk.

8. Third-Party Services and Protocols

The Service integrates with third-party protocols and services including, but not limited to: Relay (bridge provider), Dexter (x402 facilitator), Coinbase CDP (Paymaster services), and the Solana and Base blockchain networks. ClawSwap does not control these third-party services and makes no warranties regarding their availability, performance, security, or continued operation. Your use of the Service through these third-party integrations may be subject to their own terms and conditions. Disruptions, exploits, or failures of third-party services may affect your use of ClawSwap, and ClawSwap shall not be liable for any losses arising from such events.

9. Intellectual Property

The ClawSwap SDK, API documentation, and certain components of the Service may be released under open-source licenses. Where applicable, the terms of those licenses govern your use of such components. All trademarks, service marks, logos, and trade names associated with ClawSwap are the property of ClawSwap contributors and may not be used without prior written consent. Content you submit through the Service remains your property, but you grant ClawSwap a non-exclusive, worldwide license to use such content as necessary to provide the Service.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. CLAWSWAP DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

CLAWSWAP DOES NOT GUARANTEE THE ACCURACY OR COMPLETENESS OF SWAP QUOTES, ESTIMATED OUTPUTS, OR TIMING ESTIMATES. ACTUAL SWAP RESULTS MAY DIFFER DUE TO MARKET CONDITIONS, SLIPPAGE, BRIDGE DELAYS, OR BLOCKCHAIN CONGESTION.

YOU ACKNOWLEDGE THAT INTERACTING WITH BLOCKCHAIN PROTOCOLS, DECENTRALIZED EXCHANGES, AND CROSS-CHAIN BRIDGES INVOLVES INHERENT RISKS INCLUDING BUT NOT LIMITED TO: SMART CONTRACT VULNERABILITIES, BRIDGE EXPLOITS, ORACLE FAILURES, LOSS OF FUNDS, AND REGULATORY CHANGES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CLAWSWAP, ITS CONTRIBUTORS, DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION OR THEORY OF LIABILITY.

IN NO EVENT SHALL CLAWSWAP'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE TOTAL AMOUNT OF x402 FEES PAID BY YOU TO CLAWSWAP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless ClawSwap and its contributors, developers, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or inability to use the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any actions taken by Agents operating under your control or authorization.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) shall survive.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the principal ClawSwap contributors reside, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall first be submitted to good faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to binding arbitration in accordance with the rules of a mutually agreed arbitration body.

15. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and ClawSwap regarding the Service and supersede all prior agreements and understandings.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
  • Waiver: Failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
  • Assignment: You may not assign or transfer your rights under these Terms without prior written consent. ClawSwap may assign its rights and obligations without restriction.
  • Force Majeure: ClawSwap shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including blockchain network disruptions, protocol upgrades, regulatory actions, or natural disasters.
